US Immigration and Customs Enforcement (ICE) Announces Extension of Remote I-9 Verifications through end of 2021

Hopefully, this announcement means we have gotten past the worst of COVID-19 and brighter days are ahead.

One important thing to remember: Once normal operations resume, all employees who were onboarded using remote verification, must report to their employer within three business days for in-person verification of identity and employment eligibility documentation for Form I-9, Employment Eligibility Verification. Once the documents have been physically inspected, the employer should add “documents physically examined” with the date of inspection to the Section 2 additional information field on the Form I-9, or to section 3 as appropriate.

The ICE guidelines related to virtual review are not mandatory. Employers can follow standard Form I-9 procedures, including using authorized representatives to complete verification on the employer’s behalf.

This short extension will provide employers with some additional time to ensure they prepare a strategy to verify the eligibility documents of those hired utilizing the remote verifications process during the pandemic.
